Terms of Service

These Terms govern your access to and use of Kineta. If you do not agree to these Terms, do not use Kineta.

1. The Service

Kineta is a fitness session management platform for trainers and trainees. The service may include account management, trainer and trainee profiles, member management, invites, groups, sessions, attendance, notes, chat, reminders, notifications, speech-to-text, subscription management, and related web pages.

2. Accounts

You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account. You must notify us if you believe your account has been accessed without permission.

3. Trainers, Trainees, and Client Records

Trainers may enter information about clients, members, trainees, sessions, attendance, notes, and payments. Trainers are responsible for having the rights, permissions, and legal basis needed to add, use, and share that information in Kineta.

4. Health and Fitness Disclaimer

Kineta is a business, scheduling, communication, and training management tool. Kineta does not provide medical advice, diagnosis, treatment, emergency services, or professional fitness instruction. Trainers are responsible for their own coaching, client safety, qualifications, legal obligations, and professional decisions.

5. User Content

You keep ownership of content you submit to Kineta, such as profile information, notes, messages, images, feedback, and other app content. You grant Kineta the rights needed to host, process, transmit, display, and use that content to operate, secure, support, and improve the service.

6. Chat Safety, Reports, and Blocking

Kineta chat is intended for training-related communication between trainers, trainees, group members, and session participants. Kineta may use automated or manual filtering and moderation tools to prevent objectionable material from being posted or distributed.

You can report a conversation or an individual message from inside the app. Reports may include the reported message, chat context, reporter information, reported user information, timestamps, reason, details you provide, and review status. Kineta reviews reports and safety concerns and may respond by removing or restricting content, limiting features, blocking contact, suspending or terminating accounts, contacting affected users, or taking other reasonable action.

You can also contact Kineta about safety or abuse concerns at info@kineta.app. We aim to review reports and respond to urgent safety concerns in a timely manner.

You can block abusive or unwanted users from chat. Blocking a user may prevent private messaging between you and that user, hide that user's messages or activity from your view in shared chats where supported, and reduce future contact through Kineta. Users are not notified when you block them, and you can manage blocked users in the app.

7. Subscriptions and Payments

Paid features may be offered through app stores and managed through RevenueCat or similar billing tooling. App store payment terms, cancellation rules, refund rules, and subscription management settings may apply. Kineta does not collect payment card numbers directly through the app.

8. Acceptable Use

  • Do not access, copy, scrape, or reverse engineer Kineta except as allowed by law.
  • Do not interfere with security, availability, infrastructure, or other users.
  • Do not use Kineta to send spam, scams, abusive content, harassment, hate or discriminatory content, threats, sexual exploitation, unlawful content, malware, or content that encourages self-harm or violence.
  • Do not impersonate others or misrepresent your identity, qualifications, or relationship with another user.
  • Do not bully, intimidate, stalk, exploit, objectify, or make physical threats against another person.
  • Do not upload content that you do not have the right to use.
  • Do not share another person's private information without permission or use Kineta to violate intellectual property, privacy, publicity, consumer protection, or other rights.

9. Privacy, Availability, and Termination

The Privacy Policy explains how Kineta collects, uses, shares, and protects personal data. The Data Policy explains retention and deletion practices.

Kineta may change, suspend, or discontinue features. We may remove content, restrict features, preserve relevant records, suspend or terminate access, or report serious matters to appropriate authorities if a user violates these Terms, creates risk for other users or Kineta, causes legal exposure, or uses the service in a harmful or unlawful way.

10. Disclaimers, Liability, and Contact

Kineta is provided on an "as is" and "as available" basis to the maximum extent permitted by law. To the maximum extent permitted by law, Kineta will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost business, or personal injury arising from coaching, training, or user conduct.
